These Terms and Conditions define the operating principles and terms of use for the infinitypower.pl website, as well as the terms of sale for products and services available on the website.
1. Definitions
1. Infinity Power International Jolanta Wasilewska, Anna Modrzewska Limited Partnership, website owner, ul. Hiacyntowa 23, 05-077 Warsaw,
email address: office@infinitypower.pl.
Website – an online service platform, mediating between the Author and the User in Product sales transactions.
The Website’s address is https://www.infinitypowerinternational.com.
User – a natural person who has reached the age of 18, as well as a legal entity acquiring a Product through the Website.
Provision of electronic services – the performance of a service provided remotely without the simultaneous presence of the parties, through data transmission at the individual request of the User, sent and received using electronic processing devices, including digital compression and data storage, which is entirely sent, received, or transmitted via a telecommunications network within the meaning of the Act of July 16, 2004 – Telecommunications Law;
Materials – one or more computer files containing video recordings or other files that constitute the primary component of the Product.
Additional Materials – zero or more computer files that are an add-on to the Product.
Product – a paid access service to specific Materials and Additional Materials in the form of computer files, audio and video recordings, provided via the Internet by the Author to the User, through the Website.
Individual Session (Google Meet, Zoom, WhatsApp) – a remote meeting via an online connection.
Password – a confidential string of alphanumeric characters, known only to the User, necessary for authorized access to the Website https://www.infinitypowerinternational.com and Products, defined by the User during the first Product purchase.
Complaint – the User’s notification to Infinity Power International of a Product defect.
Complaint Process – a sequence of actions by the User and Infinity Power International aimed at reviewing the complaint made by the User, and, if accepted, also removing the Product defect.
2. General Provisions
1. By placing an order on the Website, the User declares that they acknowledge and fully accept the terms of these Regulations and undertake to comply with them. If the User does not agree with the provisions of the Regulations, Infinity Power International has the right to refuse to provide services to the User.
2. Infinity Power International reserves the right to amend these Regulations without stating a reason and at any time.
3. Any internet user (person) may freely browse the content of the Website.
4. To use the Website, standard devices and software are required, allowing for browsing websites, playing audio, and having an email inbox.
5. Users may be natural persons with full legal capacity (legal entities or organizational units without legal personality).
6. Users may use the Website only in accordance with applicable law. Infinity Power International reserves the right to refuse to provide services, delete data, or cancel an order if the User violates the law or the provisions of these Regulations.
7. Infinity Power International reserves the right to change the publication date of material due to technical or organizational reasons.
8. An individual session (Google Meet, Zoom, WhatsApp) can be arranged by setting a specific date and time for the meeting and sending a transfer confirmation to the email address: office@infinitypower.pl, according to the key provided during session booking.
9. Persons registered for training/courses/workshops who are late and do not inform us of their delay no later than the start time of the training/course/workshop, or via email at office@infinitypower.pl, or by calling 797 919 772, will not participate in the training / course / workshops.
10. Workshop participation must be confirmed 48 hours before the start of the training / course / workshop. If we do not receive confirmation of workshop participation, the reserved spot will lose its validity, despite the deposit paid.
11. A workshop participant who has paid a deposit to reserve a spot for training / a course / a workshop may not transfer their reservation to third parties; transferring a reservation to third parties is equivalent to canceling the reserved spot for the training / course / workshop, and thus the paid deposit is non-refundable.
12. Persons registering for training/courses/workshops who pay a deposit thereby agree to the principle of non-refundability of the paid deposit. The deposit is non-refundable because it guarantees the reservation of a spot for the paying client in the training / course / workshop.
13. Infinity Power International reserves the right to change the platforms on which it publishes its own digital publications, free and paid webinars, and training.
3. Rules for Using the Website
1. Through the Website, Users have the option to purchase products in the form of computer files containing video recordings or other files.
2. Orders are processed after Infinity Power International receives payment made through the payment channels available on the Website, as payment for the price and any other costs applicable to the given product. Information about the price and any other costs will always be provided on the Website and during order placement.
3. Infinity Power International reserves the right to cancel an order. The cancellation of an order by Infinity Power International results in the contract being considered not concluded.
4. Orders can be placed all year round, 7 days a week, 24 hours a day.
5. The prices of all Products on the Website are gross prices stated in Polish zloty.
6. The primary delivery method for virtual products is sending to the email address provided in the order, and for physical products, shipping to the postal address provided in the order.
7. The Product will be made available to the User no later than 48 hours from the moment Infinity Power International receives payment confirmation.
8. Infinity Power International undertakes to provide the User with a Product free of defects and consistent with the description on the Website.
9. The User will be informed by Infinity Power International about any additional payment obligations related to the main service.
10. By purchasing the Product (clicking the “add to cart”“icon and confirming the order in the “order”” tab), the User agrees to the payment associated with this Product.
4. Rules for Using Purchased Products
1. All Products made available through the Website, whether paid or free, are subject to the protection provided by the Act of February 4, 1994, on Copyright and Related Rights.
2. The User may use the purchased Products for their own use and in accordance with their purpose, i.e., to play them on electronic devices, or to store them in computer memory or other appropriate devices to familiarize themselves with the content of the work.
3. The User is not entitled to reproduce, copy, or use the Product (in whole or in part) in an unlawful manner. It is forbidden to change the electronic structure of the Product or make other modifications (e.g., removing security features). It is also not permitted to distribute the Product, make it available to third parties or intermediaries, or perform it publicly.
4. The User is obliged to ensure that no unauthorized persons use the Products in a manner inconsistent with the law or these Regulations. In the event of such situations being detected, Infinity Power International may pursue claims in this regard against the known purchaser of the product (User) for infringement of rights to a given copy of the Product.
5. Complaints and Returns
1. Any disruptions in the Website’s operation, comments and suggestions regarding it, complaints and claims should be directed electronically to the email address office@infinitypower.pl
2. If the purchased Product proves to be defective, in particular, if it does not launch or is inconsistent with the description on the Website, or if the Product has not been delivered within the period specified in these Regulations, the User may submit a complaint to Infinity Power International within 14 days of purchase.
3. A User who has concluded a distance contract may withdraw from it without giving reasons by submitting a relevant statement via email within 14 days of concluding the contract. In accordance with the Consumer Rights Act of May 30, 2014, and the paragraph “exceptions to the right of withdrawal from the contract,” the User may not return the product if:
– The Entrepreneur has fully performed the service with the express consent of the consumer, who was informed before the commencement of the service that after the Entrepreneur’s performance, they would lose the right of withdrawal from the contract,
– The subject of the service is audio or visual recordings or computer programs,
– The delivery of digital content not stored on a tangible medium, if the performance of the service began with the express consent of the consumer before the expiry of the withdrawal period and after being informed by the Entrepreneur about the loss of the right of withdrawal. To meet this deadline, it is sufficient to send the statement before its expiry to the email address: office@infinitypower.pl.
4. After the expiry of the 14-day period for withdrawal from the contract, the User loses this right.
5. In the event of exercising the right of withdrawal from the contract, the User is obliged to send a written statement of withdrawal from the contract and the account number to which the funds should be returned.
6. Infinity Power International promptly confirms to the User, via email, the receipt of the statement of withdrawal from the contract.
7. In the event of the User’s withdrawal from the contract, such contract is considered not concluded. The User loses access to the Product, while the Seller refunds the paid price. For products eligible for return, the refund should be made promptly, no later than 14 days from the receipt of the statement of withdrawal from the contract.
8. Payment will be refunded immediately after a positive review of the complaint by Infinity Power International, by bank transfer from the company account to the account number indicated by the User, unless the User explicitly indicates another settlement method via email, e.g., in products available in the store on www.infinitypower.pl. In this case, when settling with an equivalent in the form of products available in the store on www.infinitypowerinternational.com, the User does not incur fees related to payment operations.
9. Infinity Power International processes the complaint within 14 working days of receiving it, although this period may be extended if the complaint review requires more time. Infinity Power International will inform the User about the resolution of the submitted complaint via email.
10. In the event of a positively reviewed complaint, Infinity Power International will refund the money paid for the complained Product by bank transfer to the bank account indicated by the User, within a period not exceeding 30 days from the date of receipt of the return form. Infinity Power International reserves the right to deduct handling fees.
11. After a positive review of the complaint by Infinity Power International, the User undertakes to immediately delete all copies of the Product to which the complaint pertains.
12. Cancellation of a paid individual session (Google Meet, WhatsApp, Zoom) is possible up to 24 hours before the start of the scheduled individual session (Google Meet, WhatsApp, Zoom). Canceling a meeting (Google Meet, WhatsApp, Zoom) less than 24 hours in advance is equivalent to forfeiting the deposit paid for the session.
6. VAT Invoices
1. The User accepts invoices received in electronic form.
2. The User receives VAT invoices in electronic form as a PDF file. To receive an invoice, the User must enter company details, including the company’s Tax Identification Number (NIP), in the Comments field.
3. Duplicates of invoices issued and delivered in electronic form will be accepted in electronic form.
4. Infinity Power International collects and processes personal data through the Website, voluntarily provided by the User.
5. Only personal data that is necessary for Infinity Power International to provide services to the User and to ensure the highest quality of service is collected and processed.
6. Persons requesting an invoice must report this fact after paying the full amount for the product (Google Meet, WhatsApp, Zoom sessions, training / courses / workshops, audio recordings, video recordings, books) and send company details to the email address: office@infinitypower.pl on the day of concluding the sales contract, i.e., placing the order and its acceptance for fulfillment. If the User of the aforementioned products does not send the invoice details within the time mentioned above, the paid amount will be fiscalized without the possibility of issuing an invoice.
7. Final Provisions
1. Infinity Power International reserves the right to amend the provisions of the Regulations, with the proviso that contracts concluded before the amendment of the Regulations shall be governed by the version of the Regulations applicable at the time of placing the order.
2. Changes come into effect on the date of their publication on the Website.
3. In the event of non-acceptance of the new provisions of the Regulations, as referred to in point 7, section 1, the User has the option to withdraw their acceptance, which will result in the termination of the agreement between the Website and the User.
8. Disclaimer of Liability
1. Infinity Power International reserves the right to temporarily restrict access to the Website (in whole or in part) for its improvement, maintenance, or if security reasons or other reasons independent of Infinity Power International require it.
2. Infinity Power International is not liable to the User for losses and damages incurred by the user in connection with the use of the Website, adhering to information presented on the Website or contained in the Products under any circumstances, as well as for the consequences of decisions made based on such information.
3. Infinity Power International does not guarantee that information transmitted via the Internet will reach the User in an error-free, complete, and full form.
4. Infinity Power International is not responsible for damages caused by faulty operation of the transmission system, including hardware failures, delays, and disruptions in information transmission, interference by third parties, or acts of force majeure.
